Defense of State Employees Act

Members of the faculty and staff enjoy substantial protection against personal liability for acts or omissions that occur in the performance of their work.  These protections are defined in the Defense of State Employees Act.  Generally, the NC Attorney General’s Office provides defense based on the recommendation of our University Attorney.  Defense may be refused in the event the employee committed fraud, corruption or actual malice, or if the act was completely outside the course and scope of the individual’s University employment, or if two employees are suing each other. Otherwise, coverage limits are $11 million per employee, per incident with an annual aggregate limit of $25 million dollars.  For more information on this protection, please call 1-800-232-4936.
